Adrian Pacione: Adam Tiba bailed due to dads Covid-19 coma

A man charged with murder has been granted bail because his father is in a medically-induced coma and could soon die from Covid-19.

Adam Tiba, 22, was released by the Supreme Court of Victoria on Thursday while awaiting trial charged with the murder of tradie Adrian Pacione.

Police allege Mr Tiba was non-fatally stabbed in a drug deal gone wrong and went to a Lalor house with two others on July 18 last year for an intended aggravated burglary in revenge.

They couldn’t get inside and fired four shots through the front of the home into the living room, police allege.

A bullet pierced Mr Pacione’s head, killing him at the age of 20.

Mr Pacione had nothing to do with the alleged drug deal weeks’ earlier and was visiting the family at the home, police say.

Mr Tiba’s lawyer Dermot Dann QC told the court it could not be proved Mr Tiba was there, and if he was there, it could not be proved he was the one who fired the gun.

He said multiple family members of Mr Tiba had contracted and recovered from Covid-19, but his father’s situation was dire.

Mr Tiba was needed to help his mother raise three siblings aged under 18, the court heard.

His uncle put up a surety of $350,000 and he had a glass-fitting job waiting, Mr Dann said.

Prosecutor Francesca Holmes argued Mr Tiba was an unacceptable risk of committing further offences if granted bail and was alleged to have access to a gun.

Mr Tiba’s co-accused Tahmid Rahman and Abdullah Hammoud have previously been granted bail.
